ನವದೆಹಲಿ: ನಮಾಜ್ ಮಾಡಲು ಮಸೀದಿಯೇ ಬೇಕಾಗಿಲ್ಲ ಎಂದು ಹೇಳುವ ಮೂಲಕ ಸುಪ್ರೀಂ ಕೋರ್ಟ್ 1994ರ ಫಾರೂಕಿ ತೀರ್ಪನ್ನು ಎತ್ತಿ ಹಿಡಿದಿದೆ.
ಮಸೀದಿಯು ಇಸ್ಲಾಂನ ಅವಿಭಾಜ್ಯ ಅಂಗವಲ್ಲವೆಂದು 1994ರಲ್ಲಿ ನೀಡಿದ ತೀರ್ಪನ್ನು ಮರುಪರಿಶೀಲನೆಗೆ ಒಳಪಡಿಸಲು 7 ನ್ಯಾಯಮೂರ್ತಿಗಳಿರುವ ಸಂವಿಧಾನ ಪೀಠಕ್ಕೆ ವರ್ಗಾಯಿಸುವುದಿಲ್ಲ ಎಂದು ಕೋರ್ಟ್ ಹೇಳಿದೆ. ಅಷ್ಟೇ ಅಲ್ಲದೇ 1994ರ ತೀರ್ಪು ಯಾವ ಸನ್ನಿವೇಶದಲ್ಲಿ ಬಂದಿದೆ ಎನ್ನುವುದು ಮುಖ್ಯ ಎಂದು ಕೋರ್ಟ್ ಅಭಿಪ್ರಾಯಪಟ್ಟಿದೆ.

ದೇವಸ್ಥಾನ, ಚರ್ಚ್, ಮಸೀದಿಯನ್ನು ಸರ್ಕಾರ ವಶಪಡಿಸಿಕೊಳ್ಳಬಹುದು ಎಂದು ಹೇಳಿರುವ ಕೋರ್ಟ್ ಅ.29 ರಿಂದ ಆಯೋಧ್ಯೆ ಅರ್ಜಿಯ ಅಂತಿಮ ವಿಚಾರಣೆ ನಡೆಯಬೇಕೆಂದು ಸೂಚಿಸಿದೆ. ಅಯೋಧ್ಯೆ ಪ್ರಕರಣದ ವಿಚಾರಣೆ ವೇಳೆಯೂ ಮಸೀದಿ ವಿಚಾರವೂ ಪ್ರಸ್ತಾಪವಾಗಿರುವುದರಿಂದ ಈ ತೀರ್ಪು ಈಗ ಮಹತ್ವ ಪಡೆದಿದೆ.

ಏನಿದು ಪ್ರಕರಣ?
ಇಸ್ಮಾಯಿಲ್ ಫರೂಕಿ ವರ್ಸಸ್ ಭಾರತ ಸರಕಾರದ ನಡುವಿನ ಪ್ರಕರಣದ ವಿಚಾರಣೆ ವೇಳೆ 1994ರಲ್ಲಿ ಸುಪ್ರೀಂ ಕೋರ್ಟ್, ನಮಾಜ್ ಎಲ್ಲಿ ಬೇಕಾದರೂ ಸಲ್ಲಿಸಬಹುದು. ಮಸೀದಿಯೇ ಆಗಬೇಕೆಂದಿಲ್ಲ. ಮಸೀದಿಯು ಇಸ್ಲಾಂನ ಅವಿಭಾಜ್ಯ ಅಂಗವಲ್ಲ. ಈ ಕಾರಣಕ್ಕೆ ಮಸೀದಿ ನಿರ್ಮಿಸಿರುವ ಜಾಗವನ್ನು ಸರ್ಕಾರ ವಶಪಡಿಸಿಕೊಳ್ಳಬಹುದು ಎಂದು ತೀರ್ಪು ನೀಡಿತ್ತು. ಈ ತೀರ್ಪು ಪ್ರಶ್ನಿಸಿ ಮುಸ್ಲಿಂ ಸಂಘಟನೆಗಳು ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿದ್ದವು. ಅಷ್ಟೇ ಅಲ್ಲದೇ ಮಸೀದಿಯು ಇಸ್ಲಾಮ್ ನ ಅವಿಭಾಜ್ಯ ಅಂಗವಾಗಿಲ್ಲ ಎಂದಿದ್ದ ಇಸ್ಮಾಯಿಲ್ ಫಾರೂಕಿ ತೀರ್ಪನ್ನು ಪರಿಶೀಲನೆಗಾಗಿ ದೊಡ್ಡ ಸಂವಿಧಾನಿಕ ಪೀಠಕ್ಕೆ ಹಸ್ತಾಂತರಿಸಬೇಕು ಎಂದು ಅರ್ಜಿ ಸಲ್ಲಿಕೆಯಾಗಿತ್ತು.
